Deceased Tenant

A Andrews Mini Storage - Robert Clayton

Tenant is deceased. Tenant had no will. Sister has death certificate. Can the items be released to sister with only this documentation?

There should be an order from the court. That being said, is the sister listed on the lease in any way? If so, she might be able to access.

Jeffrey Greenburger says you need a 'letter of authority' or 'Letter Testamentary', along with proper identification-these are documents provided by probate court. Death certificate won't cut it because just because they're dead, doesn't mean they didn't leave a will.

A couple of things:

1) You want to make sure the "appropriate person gets the property". If someone already has the keys and the code, they can access the unit. We cannot give them the code.

2) If they do not have the keys to the unit or the access code, they will be required to show us proof that they have the rights to access. That is where the "Letters of Testamentary" or "Executor of Estate Letter" will be sufficient.

3) Our internal procedure if someone does not have keys/code is to over-lock the unit until someone can provide the paperwork proving.
